Lease of main residence πŸ‘¨β€πŸ‘§β€πŸ‘¦

πŸ“– Under the law on leases, the regions are responsible for this.

If the lessor or lessee wishes to terminate a principal residence lease when it expires, notice periods must be observed.

Notice periods vary according to the length of the lease. Leases of principal residences can be grouped into 3 categories:

  • Short-term lease: the term of the lease is a maximum of 3 years.

  • Classic" lease: the term of the lease is 9 years.

  • Long-term lease: the expected term of the lease is more than 9 years.

* The lease ends automatically on the scheduled expiry date. No termination task will be generated automatically, but the system will offer to tacitly renew the lease 1 month before the expiry date.

** The student may terminate the lease at any time, subject to two months' notice and without compensation. If the lease is due to expire and they wish to leave, they do not need to give notice to the landlord.

A termination notice will appear on your dashboard 2 months before the deadline for sending your notice.

The rules for ending contracts are less regulated than for residential contracts. The default notice period is 4 months, but this can be set when the contract is entered in the Contract termination section.

πŸ’‘ When does the notice period begin?

The notice period, which can be sent at any time (= before the due date), always starts on the 1st day of the month following the month in which it is sent. It ends at the end of a calendar month (28-29 February or 30-31 February for other months).

Examples:

For a lease of a principal residence for a term of 9 years expiring on 1 April 2021, the landlord must give 6 months' notice. The notice must be sent before 30/09/2020.

β†’ A termination task will appear from 01/08/2020

For a principal residence lease concluded for a period of 3 years (04/06/2018-03/06/2021), the landlord must give 3 months' notice. This must be sent before 28/02/2021.

β†’ A cancellation task will appear from 01/01/2021.
